1. Introduction & Definitions
These Terms & Conditions ("Terms") govern your access to and use of genigpt.net and related subdomains and services (the "Service"). The Service provides AI image generation, photo editing, and related features. "Genigpt," "we," "us," and "our" refer to the individual owner of the Service. "You" refers to the person or entity using the Service.
If there is any conflict between these Terms and non-waivable consumer laws in your country, the consumer laws prevail to the extent of the conflict.
2. Payments & Merchant of Record
We sell digital services. Payments are processed by our online payment reseller (Merchant of Record) (the "Reseller"). The Reseller handles checkout, payment processing, applicable taxes, invoicing/receipts, subscription billing, refunds, and chargebacks on our behalf. The Reseller's name and statement descriptor appear at checkout and on your receipt. For billing questions, use the billing support link provided in your receipt or contact us (see Contact).
Transition note: During onboarding, an interim processor may be used. In such cases, that processor may appear on your statement. Tax and refund handling will follow the policies posted here.
3. Eligibility & Sanctioned Regions
- You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
- You may not use or purchase the Service from jurisdictions subject to comprehensive sanctions (including, without limitation, Russia/Belarus and other OFAC/EU/UK‑sanctioned regions). We may block access or transactions from restricted locations and suspend accounts attempting to circumvent controls.
4. Accounts & Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us promptly if you suspect unauthorized access.
We reserve the right to immediately suspend or terminate accounts that:
- Attempt to bypass content filters or safety measures
- Repeatedly attempt to generate prohibited content
- Violate these Terms in any way
- Engage in any form of abuse or harmful behavior
5. Subscriptions, Renewal & Cancellation
- Paid plans renew automatically at the interval shown at checkout.
- You can cancel at any time before the next renewal via the self‑serve link in your receipt/checkout or by emailing [email protected].
- Cancellation stops future billing. Past charges are not refunded except as described in the Refund & Cancellation Policy.
- We may update plan features or prices with notice; changes apply on your next renewal.
6. Acceptable Use & Content Policies
Prohibited Content & Activities
You agree NOT to use the Service to:
- Generate adult, sexually explicit, or NSFW content of any kind
- Create deepfakes, impersonations, or misleading representations of real persons
- Generate images using celebrity likenesses or copyrighted characters
- Create content using any person's likeness without their explicit written consent
- Produce imagery that could be used for misinformation, fake news, or deception
- Generate, upload, or share illegal content including:
- Child sexual abuse material (CSAM) or any sexual content involving minors
- Extremist or terrorist content
- Content that promotes violence, hatred, or discrimination
- Violate laws or third-party rights (including intellectual property, privacy, or publicity rights)
- Harass, defame, stalk, or invade the privacy of others
- Bypass or attempt to bypass security measures, content filters, rate limits, geo-blocking, or sanctions controls
- Reverse engineer, scrape at scale, or access the Service using automated means except as expressly permitted
- Interfere with Service integrity or availability
- Use the Service for any illegal, harmful, or malicious purpose
We actively monitor for violations and will remove content, suspend accounts, and report illegal activities to appropriate authorities.
7. Content Moderation & Safety
Multi-Layer Safety System
We employ comprehensive automated content filtering that makes generating prohibited content technically impossible:
- Pre-Generation Screening: All prompts are analyzed by Moderation API before processing
- Generation-Time Filtering: Moderation API operates in safe mode with built-in content restrictions
- Post-Generation Detection: Advanced NSFW detection analyzes all generated images
- Automatic Blocking: Any content flagged at any stage is immediately blocked and not delivered
Reporting & Enforcement
While our automated systems prevent harmful content generation, users may report any concerns to [email protected]. We are committed to implementing additional reporting features as needed for compliance and safety.
Upon receiving reports or detecting violations, we will:
- Investigate promptly and thoroughly
- Remove any violating content that may have bypassed filters
- Suspend or terminate accounts involved in violations
- Report illegal activity to law enforcement when appropriate
- Implement additional safety measures as needed
AI Ethics Commitment
We are committed to responsible AI use and continuously improving our safety measures to prevent misuse while enabling creative expression within appropriate boundaries.
8. Content & Intellectual Property
Your inputs/uploads
You retain ownership of prompts, uploads, and other content you provide. You grant us a worldwide, non‑exclusive license to process, store, and use that content solely to operate, secure, support, and improve the Service.
Consent Requirements
If you create content featuring identifiable individuals:
- You must have explicit written consent from those individuals
- You are solely responsible for obtaining and documenting such consent
- You agree to indemnify and hold us harmless against any claims related to unauthorized use of likeness
- We may request proof of consent at any time
Outputs
Subject to applicable law and third‑party rights, you may use outputs you generate for lawful purposes. We do not guarantee exclusivity or that outputs will be unique or free from resemblance to outputs generated for others.
Responsibility
You are responsible for ensuring your inputs/outputs and use of the Service comply with all applicable laws, licenses, and third‑party rights. This includes ensuring you have all necessary rights, permissions, and consents for any content you create or use.
9. Service Changes & Availability
We may add, modify, or discontinue features from time to time. We will try to provide reasonable notice of material changes.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. AI OUTPUTS MAY BE INACCURATE, OFFENSIVE, OR UNSUITABLE FOR YOUR PURPOSE; YOU SHOULD REVIEW OUTPUTS BEFORE USE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
12. Privacy Policy
Who we are
Genigpt (individual) is the controller for the site/app data described here. For checkout and billing, our Reseller (Merchant of Record) is the controller of payment details and tax/invoicing data. We receive limited transaction metadata (e.g., amount, product, timestamps, buyer email/ID) to operate your account.
Data we collect
- Account & contact: email and optional profile details.
- Usage & content: prompts, uploads, generated outputs, feature settings, and logs necessary to run the Service and ensure safety.
- Safety data: Records of content moderation actions and filter triggers for safety and compliance.
- Device/technical: IP address, browser/OS, and cookies or similar technologies for authentication, security, and analytics.
- Payments: Payment details are submitted to the Reseller at checkout; we do not collect or store full card data.
How we use data
- Provide and improve the Service (generation, editing, account support, safety).
- Prevent abuse, fraud, and violations (including sanctions/geo‑compliance).
- Enforce content policies and safety measures.
- Analytics and performance monitoring.
- Legal compliance (tax/audit records, lawful requests).
Sharing
- Reseller (MoR): checkout, tax, invoicing, refunds, subscriptions, chargebacks.
- Safety providers: NSFW detection services—solely for content moderation.
- Vendors/processors: hosting, storage, logging, analytics, email/support—under agreements that require them to follow our instructions.
- Legal/compliance: where required by law or to enforce our Terms, protect rights, or comply with sanctions/export controls.
14. Data Retention
We keep account and transactional records as needed to operate the Service and meet legal/tax obligations. You may request deletion of your account/content; we may retain certain records as permitted or required by law (e.g., fraud prevention, tax, safety compliance).
15. International Data Transfers
We and our vendors may process data in multiple countries. Where required, we implement appropriate safeguards (such as data processing agreements and approved transfer mechanisms).
16. Your Privacy Rights
Depending on your location, you may have rights to access, correct, delete, or export your data, or to object to or restrict certain processing. To exercise these rights, contact [email protected]. For checkout/billing data managed by the Reseller, use the billing support link in your receipt.
Our Service is not directed to children under 18. If you are under 18, you may not use this Service.
17. Refund & Cancellation Policy
Subscriptions
- Subscriptions renew automatically at the interval shown at checkout.
- Cancel any time before the next renewal via the self‑serve link in your receipt or by emailing [email protected].
- No refunds for partially used billing periods after cancellation takes effect, except where required by law.
First‑purchase fairness window
For your first subscription purchase with us, you may request a refund within 14 days if a technical issue prevents use and we cannot resolve it, or if the Service was materially not as described. Include your order email and details of the issue.
Duplicates & unauthorized charges
If you were charged multiple times in error or suspect an unauthorized charge, contact us with your order details; we (and/or the Reseller) will help resolve it.
One‑time credits/top‑ups (if offered)
Credit packs and consumed usage are non‑refundable once used, unless required by law.
Terms violations
Accounts terminated for Terms violations, including attempts to generate prohibited content, are not eligible for refunds.
Sanctioned regions
We (and the Reseller) cannot accept orders from sanctioned locations; attempts to bypass geo‑blocking or export controls are not eligible for refunds.
18. Export Controls & Sanctions Compliance
You agree not to use the Service in violation of export controls or sanctions and not to provide access from sanctioned jurisdictions. We and/or the Reseller may suspend or terminate service to comply with law.
19. Governing Law & Disputes
These Terms are governed by the laws of Dubai, United Arab Emirates, without regard to conflict‑of‑laws rules. Courts of Dubai have exclusive jurisdiction, subject to any non‑waivable consumer rights in your country.
20. Changes to these Terms
We may update these Terms. Material changes will be posted here and take effect upon posting (or as otherwise stated).
